This action arises from a sex and age discrimination suit filed by appellant under 42 U.S.C. § 2000(e) and 20 U.S.C. § 629. Appellant worked for defendant as a Sales Representative from May 1979 to February 1980. At the end of the ten months appellant broke her arm. She informed defendant she could not return to work until March 24, 1980, and took in effect a fifty-four day medical leave. On March 6, 1980, Blue Cross terminated appellant, allegedly pursuant to its short-term disability policy for employees with less than one years employment at the company. In May 1980, appellant filed a charge of sex and age discrimination against Blue Cross with the EEOC. She filed suit in the district court five months later.
